TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the website, online store, content, products, and related services made available by Signature Legacy, a curated commerce and editorial platform operated by Signature Masterpiece Co., Ltd. (“Signature Legacy,” “we,” “us,” or “our”).

By visiting, browsing, interacting with, purchasing from, or otherwise using our website or Services, you agree to be bound by these Terms and by our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies referenced on our website. If you do not agree, you must not use the Services.

Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

1. ELIGIBILITY AND ACCOUNT

You may use the Services only if you are at least the age of majority in your place of residence and are legally capable of entering into a binding agreement.

If you create an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for all activity occurring under your account. You may not transfer, sell, assign, or sublicense your account to any other person.

2. THE SERVICES

Signature Legacy provides a curated online environment for discovering and acquiring selected Korean masterworks, heritage crafts, limited releases, editorial content, films, collector services, reservation programs, and related services.

We may modify, suspend, or discontinue any part of the Services, temporarily or permanently, at any time and without prior notice, subject to applicable law.

3. PRODUCT NATURE, ARTISANSHIP, AND PRESENTATION

Many works offered through Signature Legacy are handmade, limited in quantity, one-of-a-kind, individually finished, made-to-order, commissioned, reserved, or created using natural materials and traditional Korean heritage craft methods.

As a result:

- no two works will be exactly identical;
- variations in tone, grain, shell pattern, lacquer depth, glaze behavior, firing marks, dimensions, hand-finishing, surface character, material expression, or other details may occur;
- such variations are part of the nature, authenticity, and value of artisan-made work and do not constitute defects.

We make reasonable efforts to present our works as accurately as possible. However, colors, texture, luster, scale, finish, and fine detail may appear differently depending on your device, display settings, lighting conditions, or screen resolution. Product photography, editorial content, and film content are illustrative and do not guarantee perfect visual equivalence.

All product descriptions, prices, specifications, availability, estimated timelines, and related materials are subject to correction or change at any time before order acceptance.

4. ORDERS AND ACCEPTANCE

Your submission of an order constitutes an offer to purchase. We reserve the right to accept or decline any order in our sole discretion, including in cases involving product availability, pricing errors, suspected fraud, export restrictions, customs risk, production limitations, artisan availability, or other legitimate business reasons.

An order is not accepted until we send you an order confirmation or otherwise expressly confirm acceptance. Payment must be successfully authorized and processed before acceptance is complete.

If we reject, modify, or cancel an order after submission, we will attempt to notify you using the contact details provided at checkout and, where appropriate, refund any payment received in accordance with applicable law and our policies.

5. MADE-TO-ORDER, ARTISAN PRODUCTION, AND LIMITED ALLOCATION

Many Signature Legacy works are not ordinary mass-produced goods. They may be made-to-order, individually finished, allocated to a specific collector, reserved in limited release, or prepared through a heritage craft process involving Korean master artisans.

Depending on the work, production, finishing, documentation, certification, packing, and international fulfillment may generally take approximately one to six months after order confirmation. The exact timeline may vary depending on the artisan’s schedule, the complexity of the work, material readiness, certification preparation, export documentation, packing requirements, weather, logistics, customs procedures, and other circumstances beyond our reasonable control.

After your order is placed and accepted, we will provide a more specific estimated timeline where available.

Any production, preparation, or delivery timeline provided by Signature Legacy is an estimate only and is not a guaranteed delivery date, unless expressly stated otherwise in writing.

Reasonable delays resulting from handmade production, artisan finishing, natural drying or curing, kiln firing, lacquer curing, documentation, certification, inspection, international shipping, customs, insurance review, or logistics processing do not automatically create a right to cancel, return, exchange, or receive a refund, except where required by applicable law.

Once an order is accepted, a work is allocated, a reservation is confirmed, materials are procured, or production, finishing, certification, documentation, or packing has begun, cancellation, return, exchange, or refund may be unavailable, except where required by applicable law or expressly approved by Signature Legacy in writing.

6. PRICES, TAXES, AND CHARGES

All prices are shown in the currency indicated on the website at the time of purchase. Unless expressly stated otherwise, prices do not include shipping charges, duties, import charges, customs fees, brokerage fees, local taxes, VAT, or similar charges that may apply in your jurisdiction.

You are responsible for providing accurate billing, payment, shipping, and contact information and for paying all amounts due in connection with your order.

We reserve the right to change prices, promotions, discounts, and product availability at any time prior to order acceptance.

7. PAYMENT

You represent and warrant that you are authorized to use the payment method submitted with your order and that all payment information you provide is accurate and complete.

Payments may be processed through Shopify and authorized third-party payment providers. We do not store full payment card details except as permitted through payment-processing systems made available by those providers.

For certain works, reservations, limited releases, or collector programs, we may require a deposit, reservation payment, advance payment, or full payment before allocation, production, finishing, documentation, or fulfillment begins.

8. SHIPPING, DELIVERY, TITLE, AND RISK

Shipping timelines are estimates only and are not guaranteed. Delays may occur due to artisan production schedules, certification preparation, packing requirements, customs review, courier delays, insurance review, export documentation, force majeure events, regional restrictions, or other causes beyond our reasonable control.

Unless otherwise required by applicable law, title to and risk of loss for a work pass to you upon our delivery of the item to the shipping carrier.

You are responsible for any customs duties, import taxes, brokerage fees, local taxes, or similar charges imposed by the destination country unless expressly stated otherwise.

If delivery is delayed due to customs, import review, incomplete customer information, failure to pay duties or taxes, carrier delay, regional restrictions, or circumstances outside our reasonable control, such delay does not automatically entitle you to cancel the order or receive a refund, except where required by applicable law.

9. RETURNS, REFUNDS, EXCHANGES, AND CANCELLATIONS

Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy, which forms part of these Terms.

Because many Signature Legacy works are made-to-order, limited-allocation, custom, personalized, reserved, one-of-a-kind, commissioned, or individually finished, certain works may be final sale or subject to restricted return rights.

Please review the Return & Refund Policy carefully before placing an order.

Unless otherwise required by applicable law, returns, refunds, exchanges, or cancellations may not be available after an order has been accepted, a work has been allocated or reserved, materials have been procured, or production, finishing, certification, documentation, packing, or fulfillment has begun.

Natural variation, handmade characteristics, minor differences in tone, texture, nacre, lacquer, glaze, wood grain, firing behavior, patina, hand-finishing, or other artisanal details are not considered defects where they are consistent with the handmade nature of the work.

10. DEPOSIT PRODUCTS AND RESERVED ACQUISITIONS

If we offer deposit-based products, reservation products, private collector access, or collector-credit products, the terms applicable to those offerings will be stated on the relevant product page, Deposit Policy, or related policy page.

Unless otherwise expressly stated in writing or required by applicable law, deposit products, reservation payments, allocation fees, and advance payments may be non-refundable once a work has been reserved, allocated, commissioned, placed into production, or prepared for the customer.

Unless otherwise expressly stated, deposit products are not investment products, do not accrue interest, and may be subject to eligibility conditions, expiration rules, non-transferability, restricted refundability, or other limitations.

Where a deposit is expressly described as credit toward a future purchase, it will be applied according to the applicable deposit terms provided at the time of purchase.

11. INTELLECTUAL PROPERTY

All content and materials available through the Services, including without limitation all text, editorial content, descriptions, trademarks, service marks, logos, trade names, designs, images, photographs, product photography, films, interviews, video, audio, graphics, layout, and the selection and arrangement of the foregoing, are owned by or licensed to Signature Legacy, Signature Masterpiece Co., Ltd., or their licensors and are protected by applicable intellectual property and unfair competition laws.

You may use the Services only for your personal, lawful, and non-commercial use. You may not reproduce, distribute, republish, scrape, download, modify, create derivative works from, transmit, publicly display, or otherwise exploit any part of the Services without our prior written consent.

12. AUTHENTICITY, CERTIFICATION, AND PROVENANCE

Signature Legacy may provide certificates, provenance documentation, digital records, films, editorial descriptions, or authentication-related materials in connection with certain works.

Unless otherwise expressly stated in writing, such materials are provided for collector documentation, curatorial context, and platform recordkeeping. They do not constitute an appraisal, financial valuation, investment advice, guarantee of resale value, or guarantee of future market performance.

Any digital certification, blockchain record, NFT-related record, or provenance registration, where available, is provided subject to the applicable technology, platform, provider, and legal limitations in effect at the time of issuance.

13. USER SUBMISSIONS AND FEEDBACK

If you submit reviews, feedback, suggestions, comments, images, testimonials, or other materials to us (“Feedback”), you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable right to use, reproduce, modify, publish, display, translate, distribute, and otherwise use such Feedback for operating, improving, and promoting the Services.

You represent and warrant that:

- you own or control the necessary rights to your Feedback;
- your Feedback is accurate to the best of your knowledge;
- your Feedback does not violate any law or any third-party rights.

We may, but are not obligated to, monitor, remove, or refuse any Feedback in our discretion.

14. OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may provide access to tools, features, or integrations offered by third parties. These are provided on an “as is” and “as available” basis without warranties or endorsements by us.

Your use of such third-party tools or services is at your own risk and subject to the terms and policies of the relevant third party.

15. THIRD-PARTY LINKS

The Services may contain links to third-party websites, platforms, or embedded content. We are not responsible for examining or evaluating their content, accuracy, or practices. Your use of any third-party site is at your own risk and subject to that third party’s terms and policies.

16. PROHIBITED USES

You may not use the Services:

- for any unlawful, fraudulent, abusive, harmful, or malicious purpose;
- to infringe or violate our rights or the rights of others;
- to transmit false, misleading, defamatory, obscene, or otherwise objectionable material;
- to upload malware, viruses, or harmful code;
- to scrape, crawl, spider, harvest, or collect information from the Services without authorization;
- to interfere with the operation, integrity, or security of the Services;
- to use the Services for resale, unauthorized export, unlawful import, sanctions evasion, or other unauthorized commercial exploitation;
- to misrepresent the origin, authenticity, certification, authorship, provenance, or condition of any work acquired through the Services.

We reserve the right to suspend or terminate access if we believe you have violated these Terms.

17. SHOPIFY HOSTING AND SHOPIFY RELATIONSHIP

Our store and certain commerce features are hosted or enabled by Shopify. Shopify may process data submitted through the Services in order to provide hosting, checkout, customer privacy tools, fraud prevention, analytics, payment-related functionality, and related commerce services.

However, unless otherwise expressly stated, any sales and purchases you make through our store are transactions with Signature Legacy / Signature Masterpiece Co., Ltd., not with Shopify. To the fullest extent permitted by law, Shopify is not responsible for the sale, delivery, condition, authenticity, certification, return, refund, exchange, production, or performance of works sold through our store.

18. PRIVACY

Your submission of personal information through the Services is governed by our Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy and understand how your information is collected and processed.

19. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL WORKS, PRODUCTS, CONTENT, AND MATERIALS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, EXCEPT AS EXPRESSLY STATED BY US IN WRITING.

WITHOUT LIMITING THE FOREGOING, WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

NOTHING IN THESE TERMS EXCLUDES ANY WARRANTY OR RIGHT THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

20. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER SIGNATURE LEGACY, SIGNATURE MASTERPIECE CO., LTD., NOR ANY OF THEIR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, LOSS OF OPPORTUNITY, OR LOSS OF EXPECTED VALUE, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES OR ANY WORKS PURCHASED THROUGH THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR ANY PURCHASE MADE THROUGH THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

21. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Signature Legacy, Signature Masterpiece Co., Ltd., and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or relating to:

- your breach of these Terms;
- your misuse of the Services;
- your violation of any law or third-party rights;
- your improper resale, export, import, handling, storage, installation, or use of any work; or
- your Feedback or other materials you submit.

22. TERMINATION

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or if continued access could create legal, security, reputational, or operational risk.

Any provisions that by their nature should survive termination will survive, including those relating to intellectual property, feedback, disclaimers, limitation of liability, indemnification, governing law, dispute-related provisions, return restrictions, payment obligations, and reserved acquisitions.

23. GOVERNING LAW AND JURISDICTION

These Terms and any dispute arising out of or relating to them, the Services, or any purchase made through the Services shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of laws principles.

Unless otherwise required by applicable consumer law, the courts of Seoul, Republic of Korea shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

24. SEVERABILITY

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

25. NO WAIVER

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

26. ENTIRE AGREEMENT

These Terms, together with the policies referenced herein and any product-specific terms, deposit terms, reservation terms, or written terms provided at the time of purchase, constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous communications or agreements relating to the same subject matter.

27. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will post the revised version on this page and update the “Last updated” date above. If required by applicable law, we will provide additional notice for material changes.

Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms.
